Il contributo si propone l’obiettivo di rappresentare le principali novità sostanziali e processuali introdotte in materia di diritto di famiglia dal Decreto Legislativo 10 ottobre 2022, n. 149 della c.d. Riforma Cartabia.
La riforma ha inteso in primis valorizzare i cambiamenti, fattuali e giuridici, che dal 1975 hanno interessato la nostra società, dettando una disciplina processuale organica e unitaria valevole per la generalità dei procedimenti contenziosi in materia di persone, minorenni e famiglie, in modo tale da superare la molteplicità e la proliferazione dei modelli processuali finora vigenti in materia.
Non a caso la L. n. 206/2021 utilizza, per la prima volta, il termine “famiglie”, in quanto non esiste un modello immutabile di famiglia, ma vari tipi storicamente condizionati da eventi culturali, sociali, economici e lavorativi, per cui risulta opportuno parlare di famiglie o meglio di relazioni familiari.
